TERMS OF SERVICE

The following provisions establish the terms and conditions of sale for products offered for sale on www.magneto-shop.com (hereinafter "the Website") by:

Article 1 — Purpose

These terms and conditions exclusively govern the sale of products offered on the Website. They define the terms of distance selling between MAGNETO and any non-commercial adult individual (hereinafter "the Customer") making a purchase on the Website. By placing an order, the Customer fully and unconditionally accepts these terms and conditions.

Any condition put forward by the Customer that contradicts these terms shall be unenforceable against MAGNETO unless expressly accepted. The fact that MAGNETO does not invoke any of these terms at any given time shall not be construed as a waiver of the right to invoke them at a later date.

These terms are written in French and English. In the event of any discrepancy between the two versions, the French version shall prevail. We reserve the right to correct the content of the Website at any time and without prior notice.

Article 2 — Products

The products offered for sale are those listed on the Website at the time of consultation by the Customer.

MAGNETO makes every effort to ensure that the photographic representation of products is as accurate as possible. However, the perception of colours or materials on screen may slightly differ from the actual product. MAGNETO undertakes to deliver products that comply with current safety and health regulations, in accordance with applicable European directives.

Article 3 — Prices

Product prices are quoted in euros, inclusive of all taxes (VAT included), excluding delivery costs which remain the responsibility of the Customer unless otherwise stated.

Placing an order constitutes acceptance of the prices and product descriptions available for sale. MAGNETO reserves the right to modify prices in the event of increased costs, particularly changes in VAT rates, or in the case of a manifest error.

Article 4 — Orders and payment

4.1 Placing an order

The Customer completes their order by following these steps:

  • Step 1: select products and add them to the cart after choosing the desired size and colour.
  • Step 2: review the cart contents and total amount (VAT included, excluding shipping). Click "Checkout".
  • Step 3: validate the cart. If the Customer has a promo code, it must be entered at this stage.
  • Step 4: log in (existing account) or enter delivery and billing details. The Customer ticks the box confirming acceptance of these terms and conditions.
  • Step 5: enter payment details on the secure payment page. In case of failure, the Customer has 3 additional attempts.

4.2 Order confirmation

MAGNETO immediately confirms order registration by email to the address provided by the Customer. This email summarises the items ordered, delivery details and confirms the transaction.

4.3 Archiving

Order details are archived on Shopify's secure servers. No bank card number is stored by MAGNETO. The order confirmation constitutes proof of the contractual relationship between the parties.

Article 5 — Payment terms

5.1 Credit/debit card

Payment is made in full online at the time of placing the order. Accepted cards: Visa, Mastercard, Visa Electron, Maestro, Bancontact (Belgium).

5.2 PayPal

MAGNETO reserves the right to verify the validity of the PayPal account and the sufficiency of the balance. MAGNETO reserves the right to refuse a purchase.

5.3 Bank transfer

You have 48 hours to complete the bank transfer after validating your order. After this deadline, the order will be automatically cancelled.

5.4 Magneto gift card

You may pay for all or part of your order using a Magneto gift card. For more information on terms of use, please refer to the dedicated page on the Website.

5.5 Installment payments

Payment in 3 instalments is available for orders of €100 or more. The card expiry date must be at least 4 months after the purchase date. Payment in 4 instalments is available with a processing fee charged to the customer.

5.6 Payment security

All card payments are secured by Shopify Payments via 3-D Secure and SSL encryption. Payment data is transmitted in encrypted form and is never stored by MAGNETO.

Article 6 — Delivery

6.1 Delivery address

MAGNETO delivers worldwide, subject to stock availability. Orders are delivered to the address provided by the Customer at checkout (home address, pick-up point or post office), via Mondial Relay or Colissimo.

Orders are processed Monday to Friday, generally within 24 hours. Delivery times in mainland France typically do not exceed 5 days after dispatch. During peak periods (promotions, sales), processing time may be extended to 3-4 business days.

In case of absence at the time of delivery, a missed delivery notice will be left and the parcel will be held at the nearest post office. In the event of a significant delivery delay, this must be reported within 30 days by email to contact@magneto-shop.com. An investigation will be opened with the carrier.

6.2 Shipping costs

Shipping costs are charged to the Customer and are displayed at checkout. For any destination not covered by our standard rates, please contact us at contact@magneto-shop.com.

6.3 Order compliance

In the event of a non-compliant delivery (missing, damaged or incorrect item), the Customer has 7 business days from receipt to contact us at contact@magneto-shop.com with photos of the issue and their order number.

If the non-compliance is confirmed, MAGNETO will provide a prepaid return label and offer the following options:

  • Delivery of an identical product, subject to stock availability
  • Delivery of a product of equivalent quality and price, subject to stock availability
  • Full refund of the product price, processed within 15 business days of receiving the return

After the 7-day period, no claims will be accepted.

Article 7 — Right of withdrawal

In accordance with article L221-18 of the French Consumer Code, the Customer has 14 calendar days from the date of receipt of their order to exercise their right of withdrawal, without justification or penalty.

To exercise this right, the Customer must contact MAGNETO at contact@magneto-shop.com with their order number. Our customer service team will provide instructions.

Applicable conditions:

  • Items must be returned in their original packaging, with their tag, unworn, unwashed and undamaged.
  • Return shipping costs are the responsibility of the Customer.
  • Refunds are processed within a maximum of 15 business days after receipt of the return.

If these conditions are not met, MAGNETO reserves the right to refuse the return.

No returns or exchanges will be accepted on items purchased during clearance sales.

Article 8 — Order cancellation

MAGNETO reserves the right to cancel any order from a Customer with whom a dispute exists regarding payment of a previous order, or for technical or commercial reasons (pricing error, stock error, out of stock, etc.).

Article 9 — Personal data

Personal information collected is necessary for order processing, delivery and invoicing. This information is strictly confidential and intended solely for MAGNETO and its service providers for order management purposes.

In accordance with the General Data Protection Regulation (GDPR), the Customer has the right to access, rectify, delete and object to the processing of their data by contacting: contact@magneto-shop.com

Article 10 — Disputes

These terms and conditions are governed by French law. French courts shall have exclusive jurisdiction in the event of any dispute.

MAGNETO shall not be held liable for failure to perform the contract in cases of stock shortage, force majeure, disruption or strike of postal or transport services, or any damage resulting from fraudulent third-party intrusion on the Website.

In accordance with article 1124 of the French Civil Code, unemancipated minors cannot enter into contracts. Orders intended for minors must be placed by their legal guardian.

In the event of an unresolved dispute, the Customer may use the European Commission's online dispute resolution platform at: https://ec.europa.eu/consumers/odr

Article 11 — Intellectual property

Use of this website is strictly for personal use. All elements of the Website (texts, designs, photographs, logos, graphics) are the exclusive property of MAGNETO and are protected by copyright and trademark law.

Any reproduction, in whole or in part, by any means whatsoever, without the prior written consent of MAGNETO is strictly prohibited.

Article 12 — Amendments

MAGNETO reserves the right to modify these terms and conditions at any time. Updated terms will be published on the Website and will apply exclusively to sales made after the date of modification.
